Terms of Sales

Please note that all sales are final with legal warranties where applicable and exceptions below. We do not offer exchanges, refunds or warranties unless otherwise specified (e.g. Apple Care+ on selected Apple products). When you order online, you must accept all our policies, according to Articles 1434 of the Civil Code of Québec (CCQ) and 54.4 of the Consumer Protection Act (CPA).

CHAP Aubaines reserves the right to cancel an order, terminate it or not process it if the price of the merchandise or the available inventory is incorrect according to Article 1400 of Civil Code of Québec (CCQ). Our prices are labelled individually on the items or on their packaging. In some cases, it may be labelled in close proximity to the item. Our policy is available in store and online.

We are a liquidation center, which means we clear out excess inventory, returns and demos from big-box stores. All our products are sold in their original packaging previously opened for verification, unless otherwise specified. All products are tested, verified and functional.

If you have any concerns, please contact us at orders@chapaubaines.com within the delays detailled in our policy. A follow-up will be carried out by our team as soon as possible to assess the situation. (Please note that customer service delays are not a valid reason to ask for a refund.) No request exceeding the allowed delay following purchase will be processed by our team.

Please note, however, that CHAP Aubaines cannot be held responsible if an item is ordered in a specific size, color or style that does not suit you, as this information is detailled on the item card.

 

1. Item classification
All our items are verified, classified and tested before sale. Each iteam is classified by grade according to their quality at time of sale:

  • Grade 1: New item, sealed box, in original packaging.
  • Grade 2: New item, open box or no packaging.
  • Grade 3: Demo with possible traces of wear.
  • Grade 4: Damaged item or incomplete item, sold in our "Second-Hand" space. 

Wach item card mentions its grade. When ordering online, the customer can check their item in store. If the quality is different from the description, the item will be eligible for exchange, accordingly to Article 40 of the Consumer Protection Act (CPA).

 

2. Return Policy on online orders
Grade 4 implies a final sale, with no return or warranty, due to an explicit mention of all defects.

No returns or refunds are available if the item can be verified in-store. Grade 1 to 3 items can be returned within 48 hours (calendar days) of delivery if the item cannot be verified in-store or remotely.
All returns must be authorized by our customer service with a photo and a proof of purchase (invoice).
For hygiene purposes, underwear and swimsuits are not eligible for returns.

Returns are free when the item is defective. If the reason for the return is a matter of personal taste (change of mind or personal taste), a return fee will apply. For orders under $49, a flat -rate of $5 will be applied. For orders of $50 or more, a fee of 10% will be applied to the total cost.

The item will be sent for inspection at our sorting center:

  • In case of defect, an exchange will be suggested first. If this is not acceptable, a refund may be offered (either a gift card or a refund on the original payment method).
  • If an online order contains no defect, the item will be returned to the customer. For in-store orders or pick-ups, the customer will have to come to the store and pick it up.

No returns will be accepted 48 hours (calendar days) after the date on the purchase receipt in store or upon delivery of an online order. However, the store's manager or assistant manager can exceptionally authorize a return within an extended period of 7 days (calendar days), provided that a written and signed note is included on the in-store purchase receipt at the time of purchase.

 

3. Deals/Discount Codes
Our discount codes cannot be applied when there are other active deals on the products. If a discount code is applied by a system error, only one of those will apply. However, the client will have to pay the balance. This is not a valid reason to ask for a full refund with no fee.

It is impossible for us to apply a discount code once the order has been placed since the system does not allow it. Some codes are valid once per person. In that case, you can save it for a future order.

We will not change prices on previously purchased items, even in the event of a future promotion. All online orders that are eligible for refunds must be fully paid online. No deposits or partial payments are allowed, according to Article 54.3 of the Competition Act.

 

4. Pick-up delays
You must collect your order within 30 days of the order processing date. Otherwise, it will be cancelled and a fee will be applied on your refund. If you need an extension, please contact our customer service at commandes@chapaubaines.com.

 

5. Cancellation fees
CHAP Aubaines will review all requests for cancellation or return on a case-by-case basis. If the item does not match the description or has an unspecified defect, you may be eligible for an exchange, a repair, or a refund according to the Consumer Protection Act. However, reasons such as changes of mind or subjective expectations unrelated to any information provided by CHAP Aubaines may not be considered as valid grounds for a return. In such cases, a partial refund or a gift card may be given at CHAP Aubaines' discretion.

Cancellation fees apply: $5 for orders of $49 or less and 10% for orders of $50 or more. You will be notified by email 14 days before refund.

According to Article 54.13 of the CPA, in the event of contract termination, we have 15 days to refund all payments made, and you must return the items in their original packaging within 15 days of termination or delivery, whichever is later.

All terms and conditions are valid for every purchase, except when legal warranties of use or quality apply under Articles 37 and 38 of the CPA and Article 1726 of the CCQ. Legal warranties apply even on final sales.
